Subdivision and alienation of an agricultural property

The client, an agricultural producer who operates an animal farm, is considering alienating part of his property to Parc Omega inc., a foreign company involved in faunic, recreational and tourism activities as well as agricultural activities.

However, this transaction requires an authorization in compliance with the Act Respecting the Preservation of Agricultural Land and Agricultural Activities (LPTAA) and the Act Respecting the Acquisition of Farmland by Non-Residents (LATANR).

Assignment

  • Analysis of the property involved and neighbouring sites
  • Consulting on the sharing and subdivision of the property
  • Analysis of impact on agricultural activities
  • Proposal of measures mitigating the impact of this cadastral operation
  • Preparation of an authorization application to the CPTAQ, including an analysis document and rationale supporting the application
  • Representing the client to the CPTAQ
